The father, Klevis Disha, is 39. He won his appeal against deportation. His son’s food issues were an example of his needs. His son also has sensory and emotional difficulties. Politicians criticized this decision. They considered this “mind-boggling.”

The judge based Disha’s appeal on human rights laws. Deportation would impact his son. His son, C, would suffer separated from his father. C also had education plans for learning support. He had no formal special needs diagnosis.

Lawyers said C struggles with certain clothes. Socks and foods bother him. Disha entered the UK illegally in 2001. He was 15 and claimed Yugoslavian origin. His asylum claim failed, but he gained citizenship in 2007.

He got citizenship after exceptional leave to remain. He later got indefinite leave to remain. Disha had two daughters and a son with his partner. She also gained UK citizenship.

Disha was jailed in 2017 for two years. He had £250,000 in crime money. Priti Patel wanted him deported, stripping his citizenship. She said he got it through deception.

A judge supported Disha’s appeal against deportation. Sending his son away was judged unduly harsh. Another judge disagreed about C’s needs. He said they could be met in Albania. The case will be reheard by a different judge.

The judge will then decide if chicken nuggets are unduly harsh. The Home Office stated it deports foreign criminals. They said they remove them quickly. Since the election, they removed 2,580. This is a 23% increase. The Home Office doesn’t comment on individual cases. The case is ongoing.

The number of foreign criminals rose in the UK. It is now three times higher than eight years ago. Over 18,000 foreign offenders lived in the UK last year. Deportation actions will continue, said Seema Malhotra.

Neil O’Brien criticized lawyers blocking removals. He thinks human rights concerns hurt British people. Dangerous criminals remain free. The government isn’t doing enough, he said.
