The group appeared armed and ready, with someone possessing a shotgun, though police never identified the shooter. Aaron and Nathan allegedly rode in the Kia Sorrento, driving ahead of the quad bike. The twins resided on Macbean Street in North Ormesby.
Both pleaded not guilty to charges of attempted murder and firearm possession. Judge Timothy Stead directed the jury to acquit Aaron, deeming the evidence against him too weak. However, the judge considered the evidence against Nathan strong, noting his fingerprint on the passenger seat.
Subsequently, the prosecution offered no further evidence regarding the attempted murder and firearms charges. This followed Nathan’s guilty plea to a new charge: possession of a machete at the scene during the violent disagreement.
Judge Stead characterized the machete as a dangerous and formidable weapon. Nathan possessed it amidst a disorder risk that materialized into reality. Others were armed and traveled to the scene together.
While Nathan was not criminally responsible for the firearm, someone else shot the victim that day. Although he didn’t engage in fighting immediately after exiting the vehicle, his presence constituted a hostile action, according to the judge.
Nathan, aged 26, received a 20-month sentence and a lifelong restraining order, mandating he stay away from Mr. Tindall. His twin brother, Aaron, was immediately released. Sue Hirst noted Nathan’s prior robbery conviction from his teenage years. Nick Johnson, Nathan’s lawyer, stated that Nathan had no prior violent offenses.
